What is Bill 16 for condominiums in Quebec?
+
Bill 16 (S.Q. 2019, c. 28) amended the Civil Code of Québec to strengthen the rules for divided co-ownership. It requires every syndicate to keep a maintenance log, to obtain a contingency fund study and to provide a certificate on the condition of the co-ownership when a unit is sold. Its regulation (CQLR, c. CCQ, r. 8.01) has been in force since August 14, 2025.
When do the maintenance log and the contingency fund study become mandatory?
+
The regulation has been in force since August 14, 2025, and existing syndicates have a three-year transition period, until August 15, 2028, to obtain their first maintenance log and first contingency fund study. A log or study obtained in the two years before August 14, 2025 stays valid for five years if its author meets the regulation's conditions.
Who can prepare a condo's maintenance log?
+
Only a member of the Ordre des ingénieurs, the Ordre des évaluateurs agréés, the Ordre des architectes or the Ordre des technologues professionnels du Québec can establish the log, if they work mainly in property management, construction, renovation, appraisal or inspection. They must be independent: not a director, manager, co-owner or occupant of the building, nor the spouse of one.
How often must the maintenance log be revised?
+
A professional must revise the log at least every 5 years. That becomes every 10 years if the building has at most 8 private portions (not counting parking and storage), at most 3 storeys entirely above ground, or no common portion located inside a building. The board must also update the log at least once a year.
What is the syndicate's certificate, and how fast must it be provided?
+
The syndicate's certificate on the condition of the co-ownership is the document a seller must give the prospective buyer (art. 1068.1 C.C.Q.). The syndicate must provide it within 15 days of the co-owner's request. It must be dated and signed by an authorized person, with their name and title.
What must the syndicate's certificate contain?
+
At minimum: the contingency fund balance and the study's recommendation, contributions required and paid over 3 years, available cash, the surplus or deficit on the last 3 financial statements, the current budget, the syndicate's insurance, the self-insurance fund and the highest deductible, and a summary of inspections, losses, major work, pending litigation and amendments to the declaration (r. 8.01, s. 10).
What is a condo syndicate's self-insurance fund?
+
The self-insurance fund is a liquid fund every syndicate must set up (art. 1071.1 C.C.Q.). It pays the deductibles of the syndicate's insurance and damage that neither insurance nor the contingency fund covers. It is based on the deductibles plus a reasonable additional amount; in practice it is compared with the highest deductible, excluding earthquake and flood.
Must the building's reconstruction cost be appraised?
+
Yes. The syndicate's insurance must be enough to rebuild the building, and that amount must be appraised at least every 5 years by a member of a designated professional order, a chartered appraiser (art. 1073 C.C.Q.). Pignon keeps the appraisal on file and warns you before it expires.
Must the condo register be in French?
+
Yes. The register, the documents kept for co-owners and any document the syndicate writes for a co-owner must be in French (art. 1070.1.1 C.C.Q.). Pignon produces every report in French and lets you switch it to English for owners or reviewers who prefer it.
Does Pignon replace the engineer, technologist, notary or accountant?
+
No. Pignon prepares the files; it does not certify them. The log and the study are still signed by an independent professional, the financial statements are reviewed by an accountant and the certificate is signed by the syndicate. Pignon gathers the inventory, work history and supporting documents, and lets you export them or share them by secure link, which cuts billed hours.
Is Pignon a good fit for a small self-managed condo?
+
Yes, that is who it was built for. A volunteer-run syndicate of 2 to 30 units gets a compliance picture in minutes, then spends a few minutes a month confirming the invoices and documents Pignon has read and filed.
How does Pignon access my Gmail and Google Drive documents?
+
Pignon only accesses the Google Drive files you pick yourself and the documents you upload. If you connect Gmail, it only searches for attachments when you ask, read-only, and keeps only the ones you choose. Nothing goes into the register, the log or the books without your confirmation.
