Terms of service
Effective
These terms govern the use of Pignon (the "service"). By creating an account or using the service, you accept them, for yourself and for the syndicate you represent.
1. The service
Pignon helps condo syndicates keep their register, maintenance log, finances and deadlines, and prepares documents (syndicate's certificate, maintenance log update, accountant's package, insurance package, notice of meeting, package for the professional) from the data you confirm.
2. Preparatory documents, not professional advice
Documents produced by Pignon are preparatory. They are not a certification, nor legal, accounting, notarial, engineering or appraisal advice. They must be reviewed and signed by the person authorized by the board and, where applicable, by the competent professional. Automatic reading of documents can make mistakes: check each entry before confirming it. The syndicate remains responsible for meeting its legal obligations.
3. Accounts and roles
You must provide accurate information and protect access to your account. A syndicate's administrator chooses who is a member and with what role, and makes sure invited people are allowed to see that data. You confirm that your syndicate authorizes you to add its documents and the personal information they contain, including co-owners'.
4. Your content
You and your syndicate keep ownership of the data and documents you add to Pignon. You grant us only the right to host, process and display them to the people you authorize, in order to provide the service. Processing of personal information is described in our privacy policy.
5. Google services
The Google Drive and Gmail connections are optional and also subject to Google's terms. You can remove them at any time from your Google Account.
6. Public data and contractors
The contractor search uses the Régie du bâtiment du Québec's list of active licences (Données Québec, CC BY 4.0 licence), updated weekly; it may be incomplete or out of date. Check the licence on the RBQ website before signing a contract. Listing a contractor is not an endorsement and no contractor pays to be ranked.
7. Acceptable use
You agree not to use the service for illegal purposes, not to try to access another syndicate's data, not to disrupt the service or bypass its security, and not to add content you have no right to share.
8. Price
The service is free during the launch period. We will announce any price at least 30 days before it applies; you may then stop using the service and export your data.
9. Availability
Pignon is under active development. We make reasonable efforts to keep it available and data protected, without a guarantee of continuous availability. Keep the originals of your documents.
10. Liability
To the extent permitted by law, we are not liable for decisions made on the basis of documents prepared by the service, nor for indirect damages. Nothing here limits your rights under Quebec's Consumer Protection Act where it applies to you.
11. Ending use
You may stop using the service and ask for your data to be deleted at any time. We may suspend an account that breaches these terms, with notice where possible.
12. Changes
We may change these terms. We will post the new version on this page and, if the changes are significant, tell you by email at least 30 days before they take effect.
13. Governing law and language
These terms are governed by the laws of Quebec and the federal laws of Canada that apply there. The courts of the judicial district of Montréal have jurisdiction, subject to consumers' rights. These terms are offered in French and English; the French version prevails. Questions: info@carnetpignon.ca.
